Demand for rent increase

On 01.09.2001 the bye-laws for rent increase became part of the German Civil Code (BGB ).

§ 558a German Civil Code (BGB ) states:
„(1) A demand for rent increase according to § 558 has to be explained and justified to the tenant.
(2) A reference can be
1. the rent level (§§ 558c, 558d),
2. information from the rent databank(§ 558e),
3. a detailed surveyors report of a publicly appointed and sworn in expert.
4. appropriate compensation for 3 separate and comparable apartments.
(3) If an expert rent level (§ 558d section 1) includes details of the apartment, where § 558d section 2 is adhered to, then the landlord has to inform the tenant of these details in the demand for rent increase even if other reasons as in section 2 are used to justify the demanded increase.
(4) When referring to a rent level with margins, it is sufficient for the demanded rent to be in this margin. If, at the time of the landlords explanation, no actual rent level exists, according to § 558c sect. 3 or § 558d sect. 2, then another , even outdated rent level of a similar community can be used.
(5) An arrangement that puts the tenant at a disadvantage is null and void.“

My survey reports are (still) drawn up according to sections 2(3. )as an independent expert. In 2004 all surveyors will be publicly appointed and sworn in.
