How to find a qualified chartered surveyor?

In 1990 I worked on an opening balance sheet of a big business. This lead me to surveying.

What defines the title surveyor?
Surveyors are people with special knowledge and experience of a subject in a specific field. The surveyors report is indispensable in business and legal matters.
The title “surveyor” is not a legal title. The Supreme Administrative Court states, that: "Sachverständiger" meaning that „surveyors/experts“ are professionals people doing business in specific fields. This entails subject knowledge, unlimited and sound spe-cialised knowledge and experience of chartered surveying, as well as proof or certification of how the required expertise was gained" (BVerwG, Urteil vom 06.02.1997 - I ZR 234/94 (OLG Munich)

What type of qualifications for surveyors are there?
There are surveyors with very different qualifications. The European Union established a register to certify surveyors according to the European norm EN 45012, in order to simplify the search for a chartered surveyor on the European market. Similarly, the tried and tested “öffentliche Bestellung und Vereidigung” of Germany has assisted in finding a suitable surveyor in German markets for decades, but this institutes model was not used for the European model.

In particular:
ö.b.u.v. Surveyor
This is a legal title protected by § 36 of the trading regulations. These are people who have been sworn in and appointed by a public institutions (eg Chamber of Commerce and Industry, Trade Corporation, etc). Only people who are reliable, credible, knowledgeable and experienced are appointed. They are supervised by a legislative body.
According to ZPO (Code of civil procedure) § 407(2) ö.b.u.v. sur-veyors should receive preferential treatment.
Only they are permitted to use the legally binding “Rundstempel” stamp / seal.

Certified surveyor acc. to EN DIN 45013
The European Union has established a system of certification (EN 45013) for all member states and thus created a standard European trade mark.
A definite advantage of the certification as opposed to the public ap-pointment is the increased quality assurance: EN DIN 45013 certi-fied surveyors regularly have to prove their suitability and high qualification as well as their experience to the Institute of Certification.

Independent surveyor
There are approximately 50.000 independent surveyors in Germany.
This number includes the „acknowledged“ and „certified“ surveyors. These surveyors are neither certified surveyors according to DIN EN 45013, nor publicly appointed and sworn in.
The client cannot judge whether the surveyor possesses the necessary skills, experience and subject knowledge as well as the required expert knowledge. Most clients want ( especially the court) the expert to be a surveyor to be publicly appointed and sworn-in or as is increasingly the case, to be certified according to EN 45013.

Surveyors approved or certified by an association
Appointment by private surveyor associations (BGH NJW 1984). The association controls its members in the same manner as profes-sional associations. The fundamental qualities are essential, eg expert knowledge, independence, freedom to give advice, impartiality, etc. Malpractice is liable to prosecution ac-cording to §§ 1,3 UWG (law against unfair competition).
This “association certification” is NO certification according to DIN EN 45013 and therefore misleading.

Officially approved surveyor
These surveyors are bound by § 36 Abs. 5 of the Trade, Commerce and Industry Regulations Act , which in turn is linked to other legal principles ( safety regulations for engineering systems, - for equipment, etc)

How can I check the surveyors?
1. Qualification
Publicly appointed and sworn-in surveyors as well as certified surveyors had to pass an exam as proof of their expert knowledge and skills.
2. Continuing education
EA surveyor should participate in at least one 3 days of professional training per year. Ask to see the certificates.
3. The means of checking the actual qualification is by looking at an actual report - especially if placing an order for more reports or regular reports.
